Limited Warranty of KAT WALK Commercial Packages

Please read this limited warranty (hereinafter referred to as the "Limited Warranty") carefully to understand your rights and obligations. This limited warranty contains a mandatory arbitration clause.

By using your product or accessory of the KAT WALK Commercial Packages series (please refer to the attachment Product Warranty Information for specific details), you agree to the limited warranty, including the dispute settlement clauses in the Limited Warranty (the actual situation may vary according to local applicable laws.)

Definitions

The following definitions apply to this Limited Warranty:

1. "Products" refers to the KAT WALK Commercial Packages series consisting on the main components, common components, accessories and the HTC VIVE Business Edition.

2. "Main components" refers to the KAT WALK series girder, support pillar, base plate, shell, back pole, connector and sensor package provided in the product box when the equipment is purchased from the authorized dealer or KAT VR.

3. "Common components" refers to the KAT STATION computer’s case (including the screen), CPU, hard disk, main board, graphics card, memory, power supply, sound card, network card and CPU cooling system provided in the product box when the equipment is purchased from the authorized dealer or KAT VR.

4. "Accessories" refers to other secondary parts such as the waist girdle, the leg straps, the headset-holding hook, the safety rail, the logos, the base plate holder, the wheels on the lower part of the device, the cooling fan of the control center, the external switch of the control center, the internal partition of the control center, all the adapters, connecting cables, data lines and external stickers that are provided with the product in the packaging box.

5. ”You” or “Your” refers to the original retail or e-commerce purchaser and/or original end-user of the Product.

6. "Warranty period" refers to the after-sales service time, which is free of charge starting from the purchasing date of the product or accessories on the commercial invoice.

・ The warranty period of the main components and common components will not exceed 12 months and the warranty period of the accessories will not exceed 3 months.

・ Counting 12 months from the invoice date, if You cumulatively request for an on-site repair twice or you request for two man components (of the KAT WALK Series VR treadmill) to be sent to the authorized dealer or the third party service provider designated by KAT VR, then You agree to the early termination of the warranty period of the main components (the actual situation may be different according to local laws and regulations). For example:

(a) Two main components are repaired cumulatively;

(b) The same main component is repaired twice;

・ The early termination date of the warranty period of the main components is the date when the authorized dealer or third party service provider designated by KAT VR provides You with a main component repair service.

・The Warranty period of the common components and accessories: The Common components and accessories have an independent warranty period. After an early termination of the warranty period of the main components, the remaining term of the warranty period continues to apply to common components and accessories; that is, the warranty period of common components and accessories is not affected by the early termination of the warranty period of main components.

・The HTC VIVE Business Edition set warranty shall be implemented by the HTC official customer service according to their terms and regulations for the warranty of HTC VIVE Business Edition.

Please refer to the Product Warranty Information table at the end of the document for more information (the actual situation may be different according to local laws and regulations).

 

What is covered by this Limited Warranty?

During the Warranty Period, KAT VR guarantees that the Product or Accessory will be free from defects in materials and manufacturing if used under normal conditions and in accordance with the user’s instruction materials that are included with the Product or Accessory and also available for download and consultation at the KAT VR official website.

 

The Limited Warranty is given only to You. If You transfer or cede the Products or Accessories specified in the Limited Warranty to a third party, such third party can't enjoy the warranty service and any inconvenience or technical issue will be assumed by said third party.

 

What does this limited warranty not cover?

The Limited Warranty doesn't apply to any other commodities except those specified in the attached Product Warranty Information. It therefore does not apply to any non-KAT equipment or accessories or any software whatsoever, whether developed by KAT VR or a third party, even if intended or labeled as being suitable for use with the Product. Third party manufacturers, suppliers, or publishers may provide warranties for their own products and you may contact them directly for service.

 

 

Under the following circumstances, even with respect to the Products or Accessories You purchased, this limited warranty shall not apply:

1.Failure caused by detaching or disconnecting the USB data line, connecting line or power adapter without permission when the software driver of the KAT WALK Series VR treadmill is being updated.

2.The serial number, data code, watermark or warranty seal of the Product or Accessory are deleted, wiped off, dashed out, tampered with or are illegible.

3.Normal wear of the surface of the Product or Accessory;

4.Performance loss of wearable or exhaustible parts and accessories such as batteries, cushions or protective coatings over time, since such wear is expected and it does not arise out of any failure of the product;

5.Failures caused by improper installation by You or others, including but not limited to wear, deformation and crack of the shell due to noncompliance with correct installation procedure;

6. Failures caused by improper handling by You or others when changing the site, including but not limited to deformation and crack of the shell due to violent dismounting and unprotected handling by the transportation company;

7. Failures caused by electrical surge or other current problems that are not attributable to the Product or Accessory;

8.Failures caused by noncompliance with the user manual or misuse under abnormal conditions;

The use of the Product or Accessory or the corrosion and oxidation of the Product or Accessory caused by extremely harsh use, outdoor use, placing them in liquids, high humidity, high temperature conditions or other harsh environments;

10.Defects, status or other accidents caused by transformation, connection or disassembly of main components, common components or accessories of the products by unauthorized personnel, repair with unauthorized parts, or repair by unauthorized personnel at unauthorized place;

11.Other events caused by accident, force of nature or other reasons out of the reasonable control of KAT VR (including but not limited to defects of exhaustible parts), except those defects which are caused by possible direct manufacturing defects;

12.Physical damages of main components, common components or accessories, including but not limited to cracks or scratches on the surface of the main components, the common components or accessories (including any screen or lens);

13.Interruption or error in the operation of the product due to any computer or other products that can be connected to the device and whose compatibility the authorized dealer or KAT VR can't guarantee;

14.Quality problems arising from late updating of the software installed on the products, including but not limited late installation of operating system and/or firmware updates which are available for download;

15. Any products with a modified operating system and/or firmware, including any unsuccessful changes made to the operating system no matter whether such change is authorized and approved by the authorized dealer or KAT VR or otherwise prohibited;

16. Failures caused by the use or connection of main components, common components or accessories with any components or accessories that are not approved or provided by KAT VR or caused by use of main components, or the use of common components or accessories for purposes other than those specified.

 

This Limited Warranty is valid and enforceable only in the country where the Product or Accessory is intended to be sold. Moreover, if the Product or Accessory is returned to be repaired under this Limited Warranty in a country other than where it was intended to be sold, KAT VR will attempt to repair the Product or Accessory but cannot guarantee the outcome or compatibility outside the intended destination country. Warranty service availability and response times may vary from country to country and may also be subject to a registration requirement in the country of purchase (the actual situation may be different according to local laws and regulations).

 

How do I obtain warranty service?

In the event of a perceived malfunction in the Product or Accessory, You should take the following actions:

1.Refer to the user manual and/or resources available at www.katvr.com in order to identify and correct the problem. Please note that opening the Product or Accessory may cause damage that is not covered under the Limited Warranty.

2.If the problem cannot be resolved by referring to the user manual and/or resources available at www.katvr.com, you should contact the retailer from which You purchased the Product or Accessory or KAT VR service center for further information and help. Only KATVR or a KAT VR authorized service center should perform repair or maintenance service on the Product or Accessory (the actual situation may be different according to local laws and regulations).

3. When you contact the retailer or KAT, please be sure to have the following information available:

- The model and serial number of the Product or Accessory.

- Your full address and contact information.

- A copy of the original invoice, receipt or bill of sale for the purchase of the Product.   

4. You must present a valid proof of purchase upon making any warranty service request pursuant to this Limited Warranty. If You can't show valid proof of purchase and the main components and common components were produced more than fifteen months before You make the warranty service request (or the accessories were produced more than six months before You make the warranty service request), the authorized dealer or KAT VR is not obliged to provide warranty service under the Limited Warranty (the actual situation may be different according to local laws and regulations).

5.Upon completion of these steps, the authorized dealer or KAT VR will provide You with instructions regarding how and when the Product or Accessory should be returned. You may need to bear the shipping costs incurred when You return the Product or Accessory to the authorized dealer or KAT VR (the actual situation may be different according to local laws and regulations).

6.If You return the Product or Accessory during the Warranty Period and it satisfies the terms of this Limited Warranty, KAT VR or its authorized agent will, at its sole discretion, repair or replace it (the actual situation may be different according to local laws and regulations). Repair or replacement may involve the use of a functionally equivalent reconditioned Product and/or parts. The retailer or KAT VR will return the repaired or replacement Product or Accessory to You in good, normal working conditions. Any Product, Accessory, or parts or components thereof that are replaced under the terms of this Limited Warranty will become the property of KAT VR (the actual situation may be different according to local laws and regulations).

7.Rather than ask You to return the Product or Accessory, KAT VR may instead elect to supply easy-to-install parts directly to You to fulfill its Limited Warranty obligations. You in turn agree to return the replaced parts if requested by KAT VR.

8. KAT VR reserves the right to restrict warranty service to the country or countries where the Product or Accessory were intended to be sold. KAT VR must be notified of a perceived malfunction during the applicable Warranty Period in order for You to be eligible for any compensation under the Limited Warranty (the actual situation may be different according to local laws and regulations). Do not ship Your Product or Accessory directly to KAT VR unless You are asked to do so when following the steps above. If You need to return the Product or Accessory for warranty service, the steps above must be followed.

 

Exchange and return

Unless otherwise agreed by KAT, exchange or return of products isn't supported after purchase.

Unless otherwise directed by KAT VR, You should return all products (including but not limited to all attachments, components, packaging materials and promotion items, the same below) when You handle exchange or return of products. The replaced products, components and other materials shall be owned by KAT VR. The replacement parts may not be new but they have the same good performance as new ones and have the function not inferior to the replaced ones. However, should the warranty provisions of any applicable law have different requirements for replacement parts, such requirements will be fulfilled to the extent of legal warranty and the replacement parts will take over the service status of the replaced parts (the actual situation may be different according to local laws and regulations).


Before exchanging products or components, You should: 
① Remove all materials beyond the scope of warranty, such as non-factory components and changed components; 
② Make sure that the products or components are not restricted by any legal obligation or limitation that prevent such exchange; 
③ If the products or components are not owned by You, You should get the permit for providing warranty service from the owner.


Your responsibilities are as follows:


Where applicable, after You purchase the product and before we provide service, You should: 
① Follow the service application procedure specified by the service provider, e.g., product registration; 
② Back up all programs and data of the product or ensure their security; 
③ Provide necessary support to and cooperate with the service provider so that the service provider can fulfill its service function; 
④ Make sure that all personal information protected by law has been deleted from the product. With respect to any personal information that is not deleted, You should conform to all applicable laws. Please note that, we are not liable for any secret, proprietary or personal information contained in Your product. Before the product is repaired or returned, You should delete or back up all such information in the product.


 

Disclaimer and limitation of other warranties and rights

To the extent permitted by law, this Limited Warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies, and conditions. KAT VR excludes all legal and implied warranties of marketability, fitness for a particular purpose and without any hidden and latent defects.

Limits of liability

Unless otherwise specified in the Limited Warranty and to the great extent permitted by law, KAT VR is not liable for any incidental losses and damages of whatever nature (including but not limited to profit loss or business loss, business interruption, business information loss, data loss, privacy loss or confidential information loss). Notwithstanding the foregoing and even if all remedies fail to achieve the intended goal, the liability of KAT VR and its suppliers under any provisions of the Limited Warranty is limited to the amount actually paid by the customer for purchase of the product. Even though KAT VR has been informed of the possibility of such losses, these exclusive rules still apply (the actual situation may be different according to local laws and regulations).

 

Agreement upon consent to settlement of disputes by arbitration

All disputes in any form arising from the Limited Warranty or sales, conditions or the use of the Product or Accessory shall be submitted to Hangzhou Arbitration Commission for arbitration according to the arbitration rules. The arbitration is governed by laws of the People's Republic of China. The arbitrage decision is final and binding upon both KAT VR and You. If You intend to settle any dispute by arbitration as specified above, You should notify KAT VR in writing 30 days prior to initiating the arbitration. Such notice shall be sent to the following address of KAT VR Technology Co., Ltd. : 14F,BLDG.2,Haichuang Technology Center,No.1288,Wenyi West Road,Cangqian Street,Yuhang District,Hangzhou,Zhejiang, China.

Likewise, if KAT VR intends to settle any dispute by arbitration as specified above, KAT VR should notify you in writing 30 days prior to initiating the arbitration. Such notice shall explain the nature of the claim and the compensation sought. If You and KAT VR fail to settle the dispute within 30 days, You or KAT VR may make a request for arbitration. Unless your request is deemed imprudent or meaningless, KAT VR will pay all application fee for starting the arbitration procedure and any subsequent administrative expense and arbitration fee. If your request is deemed imprudent or malicious, KAT VR will not bear the arbitration fee.

Unless you have notified KAT VR in writing that you disagreement to arbitration no later than 30 calendar days after you purchase the Product or Accessory, the agreement upon consent to settlement of disputes by arbitration shall apply. You must specify in the notice to KAT VR(a) Your name and address; (b) Date when You purchase the Product or Accessory; (c) Product model; and (d) Serial number of the Product and Accessory. These contents shall be visible on product package and the product or accessory. You should send you written notice to the following address of KAT VR:

Notices of disagreement to arbitration in other forms are invalid. If You disagree to arbitration, the Limited Warranty still applies to You.

 

General rules

1.Governing law: The Limited Warranty is governed by laws of the People's Republic of China.

2. Severability: Unless otherwise specified, in the event that any provision of the Limited Warranty is held to be invalid or unenforceable, the remaining provisions of the Limited Warranty shall not be affected.
